Terms and Conditions - Twisted Fork Magic

1. Introduction These terms and conditions ("Agreement") govern the relationship between Twisted Fork Magic (referred to as "we," "us," or "our") and the client. By engaging our services, the client (referred to as "you" or "your") agrees to these terms and conditions. The purpose of these terms and conditions is to outline the expectations of both parties.

2. Scope of Services We operate as a Magician Network that connects clients with professional magicians. We will use our best efforts to provide you with suitable magicians to fulfil your entertainment needs. The specific details of the performance will be outlined in the contract invoice or performance agreement.

3. Contractual Relationship The magician(s) provided by Twisted Fork Magic are independent contractors and not employees of Twisted Fork Magic. As such, Twisted Fork Magic shall not be held liable for any acts, omissions, negligence, or misconduct of the magicians during the performance.

4. Liability Exclusion Twisted Fork Magic shall not be liable for any injury, loss, or damage to any person or property arising from the performance, acts, or omissions of the magicians, except in cases of gross negligence or wilful misconduct by Twisted Fork Magic itself. You agree to release, indemnify, and hold Twisted Fork Magic harmless from any claims, damages, or losses arising from the performance or actions of the magicians.  It is for you to check that the magicians have their own Public Liability Insurance.

5. Payment You will pay the agreed-upon fee to Twisted Fork Magic and we will pay the magician on arrival for their services. The magician does not handle money related to the performance.

6. Cancellation and Rescheduling Any cancellations or rescheduling of the performance must be communicated as soon as possible to Twisted Fork Magic as per the terms agreed upon in the contract or performance agreement. Twisted Fork Magic shall not be held liable for any cancellations or rescheduling.  Deposits are non refundable but are transferrable at our discretion.  Cancellation or rescheduling within 7 days of the performance incurs a cancellation charge of 25% of the fee.  Cancellations within 24 hours of the performance are non refundable.    

7. Promotion and Marketing Twisted Fork Magic may use photographs, videos, or promotional materials provided by the magician(s) for marketing and promotional purposes. You agree to grant Twisted Fork Magic the right to use such materials for this purpose.

8. Force Majeure Twisted Fork Magic shall not be liable for any failure or delay in performing its obligations under this agreement due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, or natural disasters.

9. Governing Law This agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the performance takes place.

10. Entire Agreement This Agreement constitutes the entire agreement between Twisted Fork Magic and the client regarding the provision of magician services and supersedes any prior agreements or understandings, whether written or oral.
