Terms and Conditions 

Introduction: These terms and conditions govern the relationship between the magician and the client. By engaging the magician's services, the client agrees to these terms and conditions. The purpose of these terms and conditions is to outline the expectations of both the client and the magician and to exclude the magician from any liability.

  1. Scope of Services: The magician will provide the services as outlined in the contract or performance agreement. The magician will use their best efforts to ensure a successful and entertaining performance.

  2. Payment: The client will pay the agreed-upon fee to the magician for the services provided. The deposit will be paid at the time of booking, and the balance will be made one week in advance of the performance.

  3. Liability: The magician shall not be liable for any injury, loss, or damage to any person or property arising from the performance, except in the case of gross negligence or willful misconduct. The client agrees to indemnify and hold the magician harmless from any claims, damages, or losses arising from the performance.

  4. Performance Area: The client shall provide a suitable performance area for the magician, free from any hazards or obstacles that could pose a risk to the performer or audience. The client is responsible for ensuring that the performance area is safe and suitable for the magician's performance.

  5. Technical Equipment: If the performance requires any technical equipment, the client shall ensure that the equipment is in good working order and properly maintained. The client shall also provide a backup plan in case of technical failure.

  6. Contractual Agreement: The client and the magician shall enter into a contract that outlines the scope of services, payment terms and dispute resolution procedures.

  7. Cancellation Rights:  Deposits are non-refundable.  If the client cancels within 7 days of the event, the balance is non-refundable but may, at the Company's discretion, be transferrable. If the client cancels on the day of the event, all monies are non refundable.  

  8. Promotion and Marketing: The magician may use the performance for promotional and marketing purposes. The client agrees to allow the magician to take photographs and videos of the performance for this purpose.

  9. Force Majeure: The magician shall not be liable for any failure or delay in performing their obligations under this agreement due to circumstances beyond their reasonable control, including but not limited to acts of God, war, terrorism, or natural disasters.

  10. Governing Law: This agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the performance takes place.

Conclusion: By engaging the magician's services, the client agrees to these terms and conditions. These terms and conditions outline the expectations of both the client and the magician and exclude the magician from any liability, except in cases of gross negligence or willful misconduct.
